Terms of Service

These Terms of Service govern your use of SportSYNC (the "Service"), operated by SportSYNC. By creating an account or using the Service, you agree to these Terms.
1. Acceptance
By accessing or using the Service you confirm that you are at least 18 years old, have the authority to bind the academy or organization you represent, and accept these Terms in full. If you do not agree, do not use the Service.
2. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@sportsync.app of any unauthorized use. We may suspend or terminate accounts that show signs of compromise or breach these Terms.
3. Acceptable use
You agree not to: (a) upload unlawful, harmful, or infringing content; (b) attempt to access data belonging to other academies; (c) reverse engineer, decompile, or attempt to derive source code from the Service; (d) use the Service to send spam or malware; (e) interfere with the integrity or performance of the Service; (f) use the Service in violation of any applicable law including data protection or child-protection laws.
4. Your data
You retain all rights to data you upload to the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to operate the Service. We will not access Customer Data except to provide support, comply with legal process, or maintain the Service. Our handling of personal data is governed by our Privacy Policy and, where applicable, the Data Processing Agreement.
5. Subscriptions and payment
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We may change pricing with at least 30 days notice. Failure to pay may result in suspension of the Service. [REVIEW: confirm refund/cancellation specifics with counsel before launch.]
6. Intellectual property
The Service, its original content, features, and functionality are owned by SportSYNC and protected by copyright, trademark, and other laws. The Service's name, logo, and brand are trademarks of SportSYNC. You may not use them without prior written permission.
7. Third-party services
The Service relies on third-party providers for hosting, error tracking, file storage, and rate limiting. Their availability and changes are outside our control. We are not responsible for downtime or data loss caused by third-party providers, but we will exercise commercial reasonable efforts to mitigate such issues.
8. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SportSYNC's TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. [REVIEW: jurisdiction-specific liability caps with counsel.]
10. Termination
You may terminate your account at any time from the Settings page. We may suspend or terminate your account for breach of these Terms or non-payment, with or without prior notice. Upon termination, your right to use the Service ceases. Customer Data may be exported during the 30 days before deletion; thereafter it is permanently removed except where retention is required by law.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
